1. Anti-Defection Law: Why Is It Important?

भारतीय संसदीय लोकतंत्र में elected representatives द्वारा political party बदलना लंबे समय से political stability और representative democracy से जुड़ा महत्वपूर्ण मुद्दा रहा है। इसे सामान्यतः political defection कहा जाता है।

बार-बार होने वाले defections को रोकने और elected governments में stability बढ़ाने के उद्देश्य से Constitution में Anti-Defection Law जोड़ा गया।

2. When Can a Legislator Be Disqualified?

Tenth Schedule कुछ परिस्थितियों में Member of Parliament या State Legislature के member की disqualification का framework प्रदान करती है।

5. Who Decides Disqualification?

Tenth Schedule के तहत disqualification से जुड़े questions पर सामान्यतः House के Speaker या Chairman निर्णय लेते हैं।

Important: Speaker/Chairman's decision को completely beyond judicial scrutiny नहीं माना जाता। Supreme Court ने Kihoto Hollohan v. Zachillhu (1992) में judicial review की possibility को मान्यता दी।

6. Judicial Independence vs Judicial Accountability
