Why in News?

Constitutional Position of Judges

किसी Judge को हटाने के लिए प्रत्येक सदन में प्रस्ताव को House की total membership के majority तथा present and voting members के कम-से-कम two-thirds majority से पारित होना आवश्यक है।

Important UPSC Trap

भारत के संविधान में Judge के removal के लिए आम तौर पर “impeachment” शब्द का प्रयोग नहीं किया गया है। संवैधानिक भाषा में Parliament द्वारा address और उसके बाद President द्वारा removal की व्यवस्था है। परीक्षा में terminology पर ध्यान देना उपयोगी है।

What Happens if the Judge Resigns During Inquiry?

यही वर्तमान बहस का मुख्य बिंदु है। यदि कोई न्यायाधीश inquiry या removal proceedings के दौरान पद से इस्तीफा दे देता है, तो removal का तत्काल उद्देश्य समाप्त हो सकता है क्योंकि व्यक्ति अब Judge नहीं रहता। लेकिन इससे accountability का प्रश्न समाप्त नहीं होता।
